Terms of Service

These Terms are a notice about what bitkong.com is and what it is not. They are not a contract between BitKong and anyone who visits the site, and they do not create a provider-of-services relationship with any member of the public. Using bitkong.com without reading them changes nothing about that. If anything here conflicts with how you wish the site worked, do not use the site.
1. Who we are
BitKong is the brand behind the original Tower — the provably-fair Bitcoin climbing game, launched in 2015. We license the game and its provably-fair technical materials to licensed gaming operators. We are not a casino. We are not an operator. We do not hold customer funds, take wagers, pay winnings, run loyalty programs, or provide any gambling service to members of the public ourselves.
References in these Terms to "BitKong", "we", "us", or "our" refer to the project and brand behind the Tower game and the provably-fair technology published on bitkong.com. "BitKong" is a project and brand identifier. These Terms do not make BitKong your counterparty for any gambling, financial, payment, or custody service — the operator is your counterparty for real-money play, always. References to "you" mean the individual using the site.
2. What these Terms cover
These Terms apply to the bitkong.com website and its contents, including:
- The free, no-money-at-stake demo of Tower.
- Informational pages (the story, the learn section, the integrate page, the verify page, documentation, and any blog or marketing content).
- The waitlist form and any direct email correspondence you initiate with us.
These Terms do not cover any gambling platform that integrates our games. When you play Tower (or any other BitKong game) for real money or real-money-equivalent value, you are doing so on a third-party operator's platform under the operator's own terms, privacy policy, and licensing regime. BitKong is not your counterparty, and these Terms do not govern that relationship.
3. The demo on bitkong.com is for evaluation only
The Tower demo on this site:
- Uses no real money and no real-money-equivalent value. There are no deposits, withdrawals, or payouts on bitkong.com.
- Is provided for entertainment, brand familiarization, and prospective-operator evaluation only.
- May be modified, rate-limited, or withdrawn at any time, without notice.
- Is not, and may not be construed as, an offer of gambling services to any person in any jurisdiction.
- Is provided without any representation or warranty that it will be available, accurate, free from defect, or produce any particular outcome.
4. Eligibility
You must be at least the age of majority in your jurisdiction (at minimum 18, and older where local law requires it) to use this site. If you are below that age, close this page and do not return until you are old enough.
You are responsible for complying with your local laws. The site is not directed at residents of jurisdictions where online gambling content, game-supplier marketing, or interactive Bitcoin-themed content is prohibited.
5. Our role vs. the operator's role vs. the liquidity provider's role
When Tower or any other BitKong game is deployed by an operator and offered to end-users for real-money play, the roles are cleanly separated:
5.1 BitKong (software and brand licensor)
- Licenses the game software, related technical materials, and brand assets to operators under separate commercial agreements.
- May, from time to time, publish technical documentation describing a provably-fair method.
That is the full scope of BitKong's involvement in any real-money deployment. BitKong does not touch money, players, or operator accounts, and does not supervise how any operator integrates, configures, monitors, or operates the game on its platform.
5.2 The operator (casino, platform, or licence holder)
- Holds the applicable gambling licence(s) and is solely responsible for regulatory compliance in every market the operator serves.
- Handles every player-facing function: registration, KYC / AML checks, age verification, sanctions screening, responsible-gambling controls, wallet custody, deposits, withdrawals, bet placement, payout, promotions, customer support, complaints, disputes, and tax reporting.
- Sets stake limits, available currencies, available markets, and availability windows.
- Is the sole counterparty to the player for every wager, payout, and dispute. The player contracts with the operator, not with BitKong.
5.3 Liquidity providers (where applicable)
Some operator platforms use third-party liquidity providers to back their exposure on games such as Tower. Where that is the case, the liquidity provider assumes the financial risk on the bet pool under a separate contract with the operator. Like BitKong, the liquidity provider is not a counterparty to the player. The player's rights, remedies, and recourse all run through the operator under the operator's terms of service and licence regime.
6. What BitKong does not do
To remove any ambiguity, BitKong:
- Does not operate gambling services to members of the public.
- Does not hold, receive, transmit, or custody player funds — whether Bitcoin, stablecoins, fiat, or any other form of value.
- Does not process deposits, withdrawals, refunds, or chargebacks.
- Does not determine whether a player wins or loses on any given round. Outcomes on an operator's platform are determined by that operator's implementation of the described method.
- Does not perform KYC, AML checks, sanctions screening, source-of-funds review, or tax reporting on end-users. Those are exclusive operator obligations.
- Does not hold a gambling licence in any jurisdiction; we do not need one to license a game and its brand assets to operators. Our licensed customers hold the licences.
- Does not offer financial advice, investment advice, tax advice, or legal advice.
- Does not monitor, audit, investigate, verify, or supervise operators, integrations, payouts, disputes, or liquidity providers.
- Does not represent or warrant that any operator is licensed, solvent, lawful, fair, available, or suitable for your use in your jurisdiction.
- Does not represent or warrant that any operator's deployment of a BitKong game conforms to any technical material published on bitkong.com.
- Does not guarantee that any operator will integrate, continue to integrate, or correctly integrate our games.
7. Provably-fair method
BitKong games are designed around a three-seed method intended to allow independent verification of outcomes by a sufficiently technical user. See /verify and /learn/the-three-seeds for an explanatory description of the method.
This is a description of a method, not a warranty of any result. The materials are published as-is, for informational and evaluation purposes. BitKong makes no representation that any specific deployment on any operator's platform conforms to the described method, that the method is free from implementation error in any given deployment, that the materials are current, complete, or sufficient to verify any specific production deployment, or that any specific outcome is profitable for a player. Past rounds are independent of future rounds; no outcome "is due".
If you wish to verify outcomes, you are responsible for doing so against the actual operator's deployment, using whatever materials that operator makes available.
8. Intellectual property
All content on bitkong.com — including the Tower game, the Kong character, the BitKong brand and logos, the story, the copy, the site design, source code we publish, the fairness documentation, and all related trademarks, trade dress, and creative assets — is owned by BitKong or our licensors and is protected by intellectual-property law. Nothing in this notice grants you any licence to use our IP except to view and interact with the site in the ordinary course of use.
Scraping, bulk-downloading, re-publishing, or using our content to train commercial AI models without our written permission is prohibited. The /llms.txt file at the root of bitkong.com describes acceptable behavior for non-commercial AI context-gathering; commercial training-data use requires a separate licence.
BitKong reserves all rights it holds under applicable copyright, trademark, trade-secret, and other intellectual-property laws, independent of any other provision of this notice.
9. Acceptable use
When using bitkong.com you should not:
- Use the site in any way that violates applicable law.
- Attempt to gain unauthorized access to any part of the site, the demo backend, or our infrastructure.
- Interfere with, disrupt, or overload the site or its services.
- Reverse-engineer the demo to extract non-public game parameters or technology.
- Impersonate BitKong, an operator, or any other person, or misrepresent your affiliation with us.
- Submit false or misleading information via our forms.
- Use the site to harvest information about other users.
BitKong may, at its discretion and without notice, block, filter, rate-limit, or otherwise restrict access to bitkong.com from any source it reasonably believes is misusing the site or threatening its infrastructure.
10. Waitlist and correspondence
If you submit your email via the waitlist form, BitKong may, but is not obliged to, email you once when Tower launches at an operator BitKong believes is relevant to you. BitKong does not intend to use that email for marketing newsletters, promotional offers, or third-party solicitations. You may ask BitKong to remove your email at any time by writing to hello@bitkong.com; requests will be reviewed and honored to the extent technically feasible, and subject to backups, legal retention, and fraud-prevention needs.

11. Third-party links and content
bitkong.com may link to operator sites, social profiles, or third-party resources. Those sites are not controlled by BitKong. We do not endorse, and are not responsible for, the content, policies, practices, availability, security, or lawfulness of any third-party site. Following a link off bitkong.com is at your own risk, and any interaction with a third party is governed by that third party's terms.
12. No warranty
The site, the demo, and all materials published on bitkong.com are provided "as is" and "as available", without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, accuracy, or freedom from error. BitKong does not warrant that the site will meet your requirements, be compatible with any specific device or system, or that any information on it is current, complete, or accurate at any given moment.
13. Limitation of liability
To the fullest extent permitted by law:
- BitKong will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost data, lost goodwill, or gambling losses suffered on any operator platform — arising out of or related to your use of bitkong.com or any BitKong game deployed by a third-party operator.
- BitKong will not be liable for any losses, disputes, delays, errors, or alleged misconduct arising from real-money play on an operator platform. Those claims run against the operator (and, where applicable, the operator's licence regulator or liquidity provider). BitKong is not a party to that dispute and has no authority, contractual or technical, to intervene in the operator's systems.
- If, despite everything above and despite the "no contract, no counterparty" position in Clause 17, any forum anywhere finds BitKong liable to you on a claim related to bitkong.com, BitKong's aggregate liability for all such claims is limited to USD 100 or the amount you have paid BitKong directly in the twelve months preceding the claim, whichever is greater. (Note: you have not paid BitKong anything for using bitkong.com. The demo is free. The waitlist is free. The site is free.)
Some jurisdictions do not allow limitation of certain liabilities. In those jurisdictions, BitKong's liability is limited to the smallest amount permitted by law.
14. If your use causes harm to BitKong
If your use of bitkong.com causes BitKong or its licensors to incur loss, expense, or damage — whether from a third-party claim, your infringement of intellectual-property or privacy rights, or your breach of applicable law — you are responsible for that harm to the fullest extent recognized by the applicable tort, statutory, and intellectual-property regimes. Nothing in this notice enlarges or reduces rights that would otherwise exist under law.
15. Gambling risk disclosure
Nothing on bitkong.com is a solicitation to gamble. Gambling involves risk. If you choose to play real-money Tower at an operator, you may lose some or all of the money you wager, and there is no strategy, pattern, or system that reliably avoids that outcome. Do not wager money you cannot afford to lose. If gambling is becoming a problem, seek help from a local responsible-gambling service such as BeGambleAware (UK), the National Council on Problem Gambling (US), or the equivalent in your country.
16. Updates to this notice
BitKong may update this notice at any time by posting a revised version at this URL and updating the "Last updated" date. Please review the page periodically. No commitment is made to individually notify you of updates.
17. No contract for services, no counterparty
This notice does not constitute a contract for the provision of goods or services between BitKong and any member of the public. BitKong offers no goods and no services to the public through bitkong.com:
- The demo has no money at stake. It is free to use and costs nothing.
- The waitlist is a one-shot courtesy notification, not a subscription.
- The rest of the site is information and brand content.
Any real-money relationship you may have with a BitKong game arises entirely between you and a licensed operator on the operator's platform, under the operator's own terms, the operator's chosen governing law, and the licence regime the operator holds. The applicable law, the forum, the disputes process, the remedies, and the regulator — all of those belong to the operator, determined by the operator's licence. BitKong is not a party to that relationship.
BitKong makes no representation, and gives no assurance, that any operator is licensed, solvent, lawful, fair, available, or suitable for your use in your jurisdiction. BitKong has no duty to monitor operators, to audit integrations, to investigate disputes, to verify payouts, or to supervise liquidity providers. Any provably-fair or technical materials published on bitkong.com may differ from any operator's actual deployment; BitKong makes no representation that any third-party deployment conforms to those materials.
If you have a dispute of any kind that can be traced to real-money play — a wager, a balance, a withdrawal, a promotion, a KYC request, an account lock, an alleged error — the remedy runs to the operator and, where applicable, the operator's regulator. It does not run to BitKong, because BitKong did not operate the platform, did not hold the funds, and did not place the bet.
18. Miscellaneous
- Severability. If any part of this notice is found unenforceable, the rest remains in effect.
- No waiver. BitKong's failure to enforce a provision is not a waiver of the right to enforce it later.
- Entire notice. This notice, together with the Privacy Policy, is the complete statement BitKong publishes about how bitkong.com operates. Nothing said privately by any person — whether by email, social media, or otherwise — overrides or adds to it.

For anything related to real-money play — a specific wager, a deposit or withdrawal, a promotion, an account balance, a KYC request, or a dispute — contact the operator where you played. BitKong cannot access, adjust, or reverse anything on an operator's platform. That is the design of the separation between software provider and licence holder.
